§ 1 Scope and provider

(1) These General Terms and Conditions (hereinafter "GTC") apply to all contracts concluded between a customer and the

via the online shop ( https://mcf-aurum.de ), by email, by telephone or in any other way.

(2) Customers within the meaning of these General Terms and Conditions are both consumers (Section 13 of the German Civil Code) and entrepreneurs (Section 14 of the German Civil Code), unless expressly provided otherwise.

(3) Deviating, conflicting or supplementary terms and conditions shall not become part of the contract – even if known – unless their validity is expressly agreed to in writing.

§ 2 Conclusion of contract in the online shop

(1) The presentation of the products in our online shop does not constitute a legally binding offer, but a non-binding invitation to submit an offer by the customer.

(2) By completing the ordering process in the shop and clicking on the "Buy now" button, the customer submits a binding offer to purchase the goods contained in the shopping cart.

(3) The purchase contract is concluded as soon as MCF Aurum GmbH accepts the offer by sending an order confirmation via email or by delivering the goods.

(4) MCF Aurum GmbH reserves the right to reject offers without stating reasons, particularly in cases of suspected fraud, incomplete information, or orders from high-risk countries. There is no entitlement to the conclusion of a contract.

§ 3 Purchase of watches by MCF Aurum GmbH

(1) MCF Aurum GmbH offers private individuals and businesses the opportunity to offer used watches for purchase.

(2) The customer can submit information about a watch via the contact form on our website or by other means to request a non-binding offer. Such an offer does not constitute a binding purchase offer from us.

(3) After reviewing the information, MCF Aurum GmbH may submit a conditional purchase offer to the customer. This offer is based exclusively on the information and photos provided by the customer and is subject to change.

(4) If interested, the customer is requested to send the watch to us at their own expense and risk, but fully insured . Shipping must be carried out by a suitable, verifiably insured carrier.

(5) Upon arrival of the watch, our watchmakers will carry out a professional and careful inspection, particularly with regard to its condition, authenticity and conformity with the information provided in advance.

(6) If, upon inspection, it turns out that the watch does not correspond to the described condition (e.g., hidden damage, scratches, non-original components), we expressly reserve the right to withdraw from the purchase without stating reasons . In this case, the customer has no right to purchase.

(7) In this case, the watch will be returned to the customer at MCF Aurum GmbH's expense. The return shipment will be insured and documented.

(8) If the verification is positive, the purchase price will be paid to the customer immediately – usually by real-time transfer .

§ 4 Right of withdrawal for consumers (returns for online purchases)

(1) Consumers are entitled to a statutory right of withdrawal of 14 days for online purchases. Details of this can be found in the separate cancellation policy, which is part of the ordering process and is also sent to the customer via email.

(2) The cancellation period begins on the day on which the customer or a third party designated by him receives the goods.

(3) The right of withdrawal does not apply to individually configured watches, custom-made products or personal customer requests , provided that these were ordered or modified according to customer specifications.

(4) Returns must be made exclusively by insurance and in the original packaging or equivalent secure packaging. The watch must be in perfect, unworn condition .

(5) If the watch shows signs of wear, damage, alterations or undocumented repairs after return, we reserve the right to:
– to refuse resignation ,
to claim compensation or
– to reduce the refund amount in accordance with the loss in value.

(6) The burden of proof of the perfect condition upon return rests with the customer. Returns are always subject to inspection .

§ 5 Prices, payment terms, shipping costs

(1) All prices quoted are final prices and include VAT.

(2) The shipping costs are:
Germany-wide: 99 €
EU countries (delivery countries): 199 €
– No delivery to: Romania, Bulgaria and other high-risk areas.

(3) Shipping is exclusively insured with tracking and a documented handover protocol.

(4) The following payment options are available:
– Credit card
– Instant bank transfer
– Cash payment upon collection (only by appointment)

(5) Payment is due immediately upon order confirmation. If payment is not received within 3 business days, we reserve the right to cancel the order.

§ 6 Delivery, Delay in Acceptance

(1) Delivery usually takes place within 2-7 working days after receipt of payment.

(2) Partial deliveries are permissible as long as they are reasonable for the customer.

(3) Should the delivery fail due to incorrect address information or refusal of acceptance, the customer shall bear the resulting additional costs.

§ 7 Retention of title

The goods remain the property of MCF Aurum GmbH until the purchase price has been paid in full.

§ 8 Warranty, guarantee, condition of the goods

(1) The statutory liability for defects applies.

(2) Used watches are covered by a 12-month dealer warranty covering functionality, authenticity and the condition described.

(3) Obvious defects must be reported to us in writing within 7 days of receipt.

(4) The guarantee does not apply in the following cases:
– improper use
– unauthorized repairs
– Transport damage that was not immediately documented
– external damage after return

(5) The watches are thoroughly inspected, documented, and photographed before shipping. Damage that can be proven to have occurred at the customer's expense will void any warranty claims.

§ 9 Liability

(1) We are liable without limitation for damages resulting from intentional or grossly negligent breaches of duty as well as for injury to life, body or health.

(2) In the event of slightly negligent breach of essential contractual obligations, our liability is limited to the foreseeable, typical damage.

(3) Any further liability is excluded.

§ 10 Data Protection

Personal data is processed in accordance with the GDPR and our privacy policy.

§ 11 Contract language, storage

(1) The contract language is German .

(2) The contract text will not be permanently stored after conclusion of the contract. A summary will be sent to the customer by email.

§ 12 Applicable law, place of jurisdiction

(1) German law shall apply exclusively, excluding the UN Convention on Contracts for the International Sale of Goods.

(2) If the customer is an entrepreneur, the place of jurisdiction is Gütersloh .

§ 13 Severability Clause

Should any provision of these Terms and Conditions be or become invalid in whole or in part, the validity of the remaining provisions shall remain unaffected. The statutory provisions shall apply in place of the invalid provision.

As of August 2025
